Love vs Money


I rarely have the interest to read the magazine, APlus issued by HKICPA. But a little title on the cover of this month version caught my attention: Love vs Money - Shopping for the best jurisdiction for a divorce is gaining popularity.

When a relationship goes wrong, don't waste any time for groaning or crying. Save every second for something more meaningful! One divorce case illustrates the importance of quick action. A wife filed divorce in Hong Kong and the husband filed it in PRC. "Filing in HK was potentially to the wife's advantage after a landmark court ruling in March 2008, which set the basis for asset splitting at 50-50. Unfortunately, the mainland court completed its proceedings on the husband suit before the wife's case was finalised. HK court can only recognise overseas divources but has no power to rule on how assets should be divided up, was therefore unable to enforce its award to the wife."

Another key issue is that you need to have a probing mind, be aware of the family financials all the time. A husband has maticulously planned everything before he proposed a divorce. "He started using a post box address to receive some correspondance, especially bank statements, instead of using residential address." You see, tricky, isn't it? The wife finally engaged a forensic accountant team to dig out the uncovered assets.

Next time, when you are totally fucked up in a bad relationship, be smart and act fast.

Instead of acting fast and smart afterward; I'd recommend and personally prefer to prepare the written agreements, which is to try to ensure that own's assets remain him/herself if the marriage fails. This is what we called, "Pre-Marital Agreements"

Unfortunately, pre-nups are not legally binding in HK.
